We operate the mobile application Twintual (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").
These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Twintual Inc., concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. If you do not agree with all of these Legal Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.), so if your interactions would be subjected to such laws, you may not use the Services.
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as the trademarks, service marks, and logos (the "Marks").
Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services solely for your personal, non-commercial use or internal business purpose. Any breach of these Intellectual Property Rights will constitute a material breach and your right to use our Services will terminate immediately.
You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username if we determine, in our sole discretion, that it is inappropriate, obscene, or otherwise objectionable.
We accept Visa, Mastercard, and American Express. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. All payments shall be in US dollars. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
Your subscription will continue and automatically renew unless canceled. The billing cycle is monthly. You can cancel your subscription at any time by logging into your account. Your cancellation will take effect at the end of the current paid term. All sales are final and no refund will be issued.
You may not access or use the Services for any purpose other than that for which we make the Services available. As a user, you agree not to:
We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, strictly in accordance with these Legal Terms. You shall not decompile, reverse engineer, make modifications, or use the App for any revenue-generating endeavor or competitive purpose.
As part of the functionality of the Services, you may link your account with third-party service provider accounts. By granting us access, we may access, store, and make available content from your third-party accounts. Your relationship with third-party service providers is governed solely by your agreements with them. We are not responsible for any third-party websites or content accessed through the Services.
We care about data privacy and security. Please review our Privacy Policy at twintual.com/privacy. By using the Services, you agree to be bound by our Privacy Policy. The Services are hosted in the United States. If you access the Services from any other region, you expressly consent to have your data transferred to and processed in the United States.
To the maximum extent permitted by law, Twintual Inc. shall not be liable for any indirect, incidental, consequential, or special damages (including loss of profits, data, or business) arising from your use of the Services. In no event shall the Company's total liability exceed the amount paid by you in the last 6 months or $100, whichever is lower.
These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services to any person for any reason. If we terminate or suspend your account, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.
These Legal Terms are governed by the laws of the State of Delaware. Any dispute shall first be attempted to be resolved through informal negotiations for at least thirty (30) days before initiating arbitration. Any unresolved disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules.
We reserve the right to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms. It is your responsibility to periodically review these Legal Terms to stay informed of updates. Your continued use of the Services after revised Legal Terms are posted constitutes your acceptance of the changes.
